Assignment of mortgage or a note endorsed in blank

{Q} The judges are saying either an assignment of mortgage or a note endorsed in blank is enough for standing for the bank. My note wasn’t endorsed in complaint so they seem to be leaning towards the assignment.

The court is enforcing the exsiting liens of record !

  • The assignment is for income and not any interest in mortgage. The assignment is an essential part of a 1031 Like-kind Exchange.
  • The blank endorsed note is a gimmick as the note was cancelled under 26 US Code section 108 (i)  Upon any election for CODI under 61 (a) (1) the note can never be enforced as the lien is extinguished.
